Power of Attorney

A Power of Attorney (PoA or POA) may be necessary to allow a transaction to be completed in Dubai but it must be stamped and attested in Dubai Courts first.

These are common documents in Dubai especially as the high percentage of expats (approx 80%) aren’t always in the country at the time of a transaction.

A Power of Attorney (PoA or POA) is a legal document which allows the person or persons named on the document to carry out duties as if they were that person.

A typing centre can organise this for you. Take your passport with you as they will take the details of both parties from the passports.

There are two types of Power of Attorney – General and Specific. If you want someone to act on your behalf for property transactions this is a Specific Power of Attorney. The Specific Power of Attorney should note the full information about the property including the Land Department Title Deed. The typing centre typist will be able to explain to you exactly what is required.

The Power of Attorney should be in Arabic and English as Arabic is the language of the Dubai Courts.

The Power of Attorney will be stamped and attested in the Dubai Courts.

If the Power of Attorney is from another country the document needs to be stamped and attested in the UAE Embassy in the country of origin. If it requires to be translated into Arabic it should be translated by a legal translator. The Power of Attorney should then be taken to the Ministry of Foreign Affairs in Dubai where it will be stamped and attested to verify it is an original document or a legal copy of the original document.

Remember only to give Power of Attorney to someone you trust implicitly.
